The Abuja Division of the Federal High Court, on Monday, gave a between time request notwithstanding the Edo State Government and Governor Godwin Obaseki, from arresting and arraigning the National Chairman of the All Progressives Congress, APC, Adams Oshiomhole, over his supposed prosecution subjected by a board of review/inquiry.
Justice Ahmed Mohammed requested all the parties to keep up their business as usual until June 17, when a preliminary objection that is challenging the jurisdiction of the court to interfere in the matter, would be heard.
The APC National Chairman had in an ex-parte movement he documented through his group of legal advisors led by Mr. West Idahosa, implored the court to stop his aresst and indictment by virtue of the white paper that was given against him by a board of inquiry the Edo state government established to test him.
But meanwhioe, before the ex-parte movement could be heard on Monday, the Edo Government, through its legal counselor, Mr. Alex Ejeiseme, SAN, raced to the court with a preliminary objection to challenge the grant of reliefs looked for by the troubled APC National Chairman who was a previous Governor of the state.
Both Governor Obaseki and the state government questioned purview of the court to engage Oshiomhole’s ex-parte application.
Aside the Edo state government, different respondents in the issue are the Attorney-General and Commissioner of Justice of Edo State, Justice J. Oyomire, the Inspector General of Police and the Department of State Service.
When this came up and after Justice Mohammed listed to the parties , he ordered the Respondents to remain in activity in regard of the case pending the assurance of the issue of jurisdiction.
The Judge held: “An interim order is hereby made restraining the indictment and prosecution of the candidate in accordance with the report submitted to the first to 3rd respondents or any white paper, pending the amdetermination of the issue of locale brought up in the first to fourth respondents notice starter complaint”.
